General Terms and Conditions of the company HAUS NEUN

§1 Validity towards Entrepreneurs and Definitions

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A "consumer" is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor attributable to their independent professional activity (§ 13 BGB).

§2 Conclusion of a Contract, Storage of the Contract Text

(1) The following regulations regarding the conclusion of a contract apply to orders via our internet shop https://www.hausneun.net.

(3) The presentation of goods in our internet shop does not constitute a legally binding contract offer on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract. (4) Upon receipt of an order in our online shop, the following regulations apply: The consumer submits a binding contract offer by successfully completing the ordering procedure provided in our online shop.

 

The order is placed in the following steps:

  1. Selection of the desired goods.

  2. Confirmation by clicking the "Order" buttons.

  3. Review of the details in the shopping cart.

  4. Clicking the "Checkout" button.

  5. Logging into the online shop after registration and entering login details (email address and password).

  6. Re-checking or correcting the respective data entered.

  7. Binding submission of the order by clicking the button "Order with obligation to pay" or "Buy".

Before the binding submission of the order, the consumer can return to the website where the customer's details are recorded by pressing the "Back" button contained in the internet browser they are using, after checking their details, and correct input errors or cancel the ordering process by closing the internet browser. We confirm the receipt of the order immediately by an automatically generated email ("Order Confirmation"). With this, we accept your offer.

(5) Storage of the contract text for orders via our online shop: We will send you the order data and our GTC by email. You can also view the GTC at any time at https://www.hausneun.net. For security reasons, your order data is no longer accessible via the internet.

§3 Prices, Shipping Costs, Payment, Maturity

(1) The prices stated are net prices (excluding VAT). Therefore, any shipping costs and VAT will be added at the end of the ordering process. (2) The consumer has the option of payment by advance payment (Vorkasse), PayPal, Credit Card (Visa). (3) If the consumer has chosen payment by advance payment, they undertake to pay the purchase price immediately after the conclusion of the contract.

§4 Delivery

(1) Unless we have clearly stated otherwise in the product description, all items offered by us are ready for immediate dispatch. Delivery takes place here within 5 working days at the latest. In the case of payment in advance, the period for delivery begins on the day after the payment order to the bank commissioned with the transfer and, for all other payment methods, on the day after the conclusion of the contract. If the end of the period falls on a Saturday, Sunday, or public holiday at the place of delivery, the period ends on the next working day. (2) The risk of accidental loss and accidental deterioration of the item sold only passes to the buyer upon delivery of the item, even in the case of a sale by dispatch.

 

§5 Retention of Title

We reserve ownership of the goods until full payment of the purchase price.

 

§6 Right of Withdrawal for the Customer as a Consumer

Right of Withdrawal for Consumers Consumers are entitled to a right of withdrawal in accordance with the following provision, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor attributable to their independent professional activity:

 

Cancellation Policy Right of Withdrawal You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

You may use the attached model withdrawal form, but this is not mandatory.

Consequences of Withdrawal If you withdraw from this contract, we must reimburse to you all payments received from you, including delivery costs (with the exception of supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the initial transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent the goods back, whichever is the earliest.

You must send back or hand over the goods to us without undue delay and in any event not later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.
